PURPOSES AND LEGAL BASIS FOR PROCESSING PERSONAL DATA

 

  1. To enter into and perform agreements, including, in particular, training agreements and agreements for the provision of electronic services within the Service; the basis for this processing is Article 6(1)(b) of the GDPR, which allows for the processing of data if it is necessary for the conclusion and/or performance of a contract,
     
  2. If an agreement is concluded between us, to fulfill the obligations provided for in applicable law (in particular, tax, civil and consumer law) - this applies, for example, to issuing invoices, fulfilling tax obligations, and obligations related to the consumer's right to withdraw from the contract; the basis for this processing is Article 6(1)(c) of the GDPR,
     
  3. To communicate with anyone who provides their personal data in the contact form or contacts me in any other way; the basis for this processing is Article 6(1)(f) of the GDPR, which allows for the processing of personal data due to the legitimate interest of the Controller - such communication is necessary to ensure proper service to the Controller's clients and thus - the proper functioning of the Service and the Controller,
     
  4. For direct marketing of services offered in the Service and informing users of the Service about its functionalities, capabilities and changes, and for statistical purposes (processing for statistical purposes may include data such as subpages visited, time spent on each of them, date and time of visits, operating system, web browser, location) as well as for managing social media profiles, including ensuring order and security, and customer satisfaction surveys; the basis for this processing is Article 6(1)(f) of the GDPR, which allows for the processing of personal data due to the legitimate interest of the Controller - such data processing is necessary to operate the Service, ensure its proper functioning and high quality of services,
     
  5. To establish, pursue or defend against claims; the basis for this processing is Article 6(1)(f) of the GDPR, which allows for the processing of personal data due to the legitimate interest of the Controller - such data processing is necessary to ensure the realization of our rights,
     
  6. Based on your consent for purposes clearly defined in the statement of consent, e.g., based on your consent to receive a newsletter; the basis for such processing is Article 6(1)(a) of the GDPR. You may withdraw your consent at any time.


Providing personal data is not mandatory, but it is necessary to use the functionalities of the Service for which the data is collected or to conclude an agreement with me for the provision of services. 

 

 

URIGHTS RELATED TO THE PROCESSING OF PERSONAL DATAH


If I process your personal data, you have the right to:
 

  • Access your personal data (upon your request, I will provide information on whether I process your data, what data I process and how),
  • Rectification of personal data,
  • Erasure of personal data (when, according to the GDPR, the data should be deleted). However, I reserve the right to retain certain personal data to the extent that they may be necessary to establish or pursue claims, defend against claims or relations with public authorities,
  • Restriction of processing of personal data (if, according to the GDPR, the processing of data should be restricted),
  • Object - for reasons related to your particular situation - to the processing of personal data that is processed on the basis of the legitimate interest of the Controller, including profiling (if the data is profiled),
  • Object to the processing of personal data for direct marketing purposes,
  • Withdraw consent to the processing of data that is processed on the basis of such consent. However, withdrawing consent does not affect the lawfulness of processing personal data before consent is withdrawn,
  • Lodge a complaint with the President of the Personal Data Protection Office if the User believes that the processing of personal data within the Service violates the GDPR.

 

The Controller may share the User's personal data with:

  1. Entities providing accounting, legal or IT services to the Controller.
  2. Entities providing software for issuing invoices (ING Usługi dla Biznesu S.A)

 

 

 

DATA RETENTION PERIOD

 

Data provided in connection with the use of the Service's functionalities is processed during the provision of services and until you object or withdraw your consent to the processing of personal data. Data provided in connection with a concluded service agreement may be processed until the limitation period for claims expires and for the period during which tax documentation must be kept. Correspondence with Users, for evidentiary purposes, may be stored for a period of 5 years.

 

 

 

DISCLOSURE OF PERSONAL DATA

 

Services provided within the Service may involve the transfer of certain personal data to other entities - this applies in situations where, through the Service, the User establishes contact with them.

 

Personal data may be transferred outside the European Economic Area (European Union). This always takes place on the basis of a specific legal basis, such as a data transfer agreement based on standard clauses or on the basis of the Privacy Shield regime. Data may be shared with entities such as:: 

  • Google (e.g., in connection with the use of email services, analytics for website statistics analysis, ads for displaying sponsored links)
  • Facebook, Instagram (social plugins, commenting system, pixel supporting the measurement of effectiveness and optimization of ads).
  • Discord Inc. (in the scope of data related to/shared by you in connection with using my services on the Discord platform).

 

 

 

PROFILING OF PERSONAL DATA

 

In order to tailor the content of the Service to the interests and needs of the Service User, as well as for statistical purposes, User data may be profiled. For this purpose, technologies will be used that store and access certain information on the User's device connected to the Internet (such as cookies). Based on the data entered in the Service, activity within the Service and through cookies, a user profile may be created. Based on this profile, specific services or functionalities of the Service will be proposed to the User. This is done automatically, but remains under the control of the Administrator.

 

You have the right to object at any time to direct marketing, including profiling of data for this purpose. In other cases of data profiling, you have the right to object for reasons related to your particular situation.

 

 

 

COOKIES

 

The Service uses "cookies".

 

Cookies are text files stored on the disk of the device used by the User (computer, phone, tablet, etc.). Cookies usually contain the name of the website they come from, the time they are stored on the device, and a unique number. Cookies can be read by the Administrator, as well as by systems belonging to other entities whose services are used within the Service (e.g., Facebook, Google).

 

Thanks to cookies, the Administrator can track the web addresses that the User visits. This data can be analyzed for internal purposes, used to manage the Service, ensure service security, register visits, for statistical and marketing purposes (as mentioned in the section "profiling of personal data").

 

The User can block the Administrator's access to cookies by adjusting the settings of their web browser. You can completely block the automatic handling of cookies or request to be notified each time cookies are placed on your device. Failure to change the browser settings is equivalent to agreeing to the use of these files by the Administrator. Additionally, the User may not agree to the use of cookies for marketing purposes. Failure to support cookies may prevent or hinder access to certain content or functions on the website.
